Terms of Use — GiftSense (Shop Mini)

Effective: 26 November 2025

1) Service

GiftSense helps you track gifting events and budgets and generates product keyword suggestions within the Shopify Shop app. Purchases/checkout are handled by Shopify/merchants, not by GiftSense.

2) Accounts & authentication

GiftSense runs inside the Shop app and uses Shop Minis authentication. You agree to keep your device/account secure and authorise token exchange to operate the Mini.

3) Your content

You may input personal details (e.g., recipient names/notes). You confirm you have any required rights/consent to include third‑party data.

4) AI suggestions

We use OpenAI to generate product keyword suggestions from your inputs. Suggestions may be inaccurate or incomplete and are provided “as is” for information only; you remain responsible for your decisions.

5) Intellectual property

Except for your inputs and third‑party products, GiftSense and related materials are owned by us or our licensors. We grant you a personal, non‑transferable, revocable licence to use GiftSense within the Shop app.

6) Prohibited use

No reverse engineering, scraping, security circumvention, unauthorised access, or misuse of tokens; do not use GiftSense unlawfully or to infringe rights.

7) Termination

We may suspend or terminate access for breach of these Terms or for security, legal, or operational reasons.

8) Warranties & liability

GiftSense is provided “as is” and “as available” to the extent permitted by applicable Belgian and EU law. Nothing in these Terms limits liability for intent, fraud, gross negligence, or for death/personal injury, or affects non‑waivable consumer rights. Subject to the foregoing and where allowed by law, our aggregate liability for the Service will not exceed EUR 100.

9) Changes

We may modify features and update these Terms. Material changes will be communicated via the app or other reasonable means. Continued use indicates acceptance.

10) Governing law & jurisdiction

These Terms are governed by Belgian law. The courts of Ghent (Belgium) will have exclusive jurisdiction, without prejudice to mandatory consumer venue rights.
